  1. Creative Commons Attribution-ShareAlike 4.0 International Public License
  2. By exercising the Licensed Rights (defined below), You accept and agree to
  3. be bound by the terms and conditions of this Creative Commons
  4. Attribution-ShareAlike 4.0 International Public License ("Public License").
  5. To the extent this Public License may be interpreted as a contract, You are
  6. granted the Licensed Rights in consideration of Your acceptance of these
  7. terms and conditions, and the Licensor grants You such rights in
  8. consideration of benefits the Licensor receives from making the Licensed
  9. Material available under these terms and conditions.
  10. Section 1 – Definitions.
  11. a. Adapted Material means material subject to Copyright and Similar Rights
  12. that is derived from or based upon the Licensed Material and in which the
  13. Licensed Material is translated, altered, arranged, transformed, or
  14. otherwise modified in a manner requiring permission under the Copyright
  15. and Similar Rights held by the Licensor. For purposes of this Public
  16. License, where the Licensed Material is a musical work, performance, or
  17. sound recording, Adapted Material is always produced where the Licensed
  18. Material is synched in timed relation with a moving image.
  19. b. Adapter's License means the license You apply to Your Copyright and
  20. Similar Rights in Your contributions to Adapted Material in accordance
  21. with the terms and conditions of this Public License.
  22. c. BY-SA Compatible License means a license listed at
  23. creativecommons.org/compatiblelicenses, approved by Creative Commons as
  24. essentially the equivalent of this Public License.
  25. d. Copyright and Similar Rights means copyright and/or similar rights closely
  26. related to copyright including, without limitation, performance,
  27. broadcast, sound recording, and Sui Generis Database Rights, without
  28. regard to how the rights are labeled or categorized. For purposes of this
  29. Public License, the rights specified in Section 2(b)(1)-(2) are not
  30. Copyright and Similar Rights.
  31. e. Effective Technological Measures means those measures that, in the absence
  32. of proper authority, may not be circumvented under laws fulfilling
  33. obligations under Article 11 of the WIPO Copyright Treaty adopted on
  34. December 20, 1996, and/or similar international agreements.
  35. f. Exceptions and Limitations means fair use, fair dealing, and/or any other
  36. exception or limitation to Copyright and Similar Rights that applies to
  37. Your use of the Licensed Material.
  38. g. License Elements means the license attributes listed in the name of a
  39. Creative Commons Public License. The License Elements of this Public
  40. License are Attribution and ShareAlike.
  41. h. Licensed Material means the artistic or literary work, database, or other
  42. material to which the Licensor applied this Public License.
  43. i. Licensed Rights means the rights granted to You subject to the terms and
  44. conditions of this Public License, which are limited to all Copyright and
  45. Similar Rights that apply to Your use of the Licensed Material and that
  46. the Licensor has authority to license.
  47. j. Licensor means the individual(s) or entity(ies) granting rights under this
  48. Public License.
  49. k. Share means to provide material to the public by any means or process thati
  50. requires permission under the Licensed Rights, such as reproduction,
  51. public display, public performance, distribution, dissemination,
  52. communication, or importation, and to make material available to the
  53. public including in ways that members of the public may access the
  54. material from a place and at a time individually chosen by them.
  55. l. Sui Generis Database Rights means rights other than copyright resulting
  56. from Directive 96/9/EC of the European Parliament and of the Council of 11
  57. March 1996 on the legal protection of databases, as amended and/or
  58. succeeded, as well as other essentially equivalent rights anywhere in the
  59. world.
  60. m. You means the individual or entity exercising the Licensed Rights under
  61. this Public License. Your has a corresponding meaning.
  62. Section 2 – Scope.
  63. a. License grant.
  64. 1. Subject to the terms and conditions of this Public License, the
  65. Licensor hereby grants You a worldwide, royalty-free,
  66. non-sublicensable, non-exclusive, irrevocable license to exercise the
  67. Licensed Rights in the Licensed Material to:
  68. A. reproduce and Share the Licensed Material, in whole or in part; and
  69. B. produce, reproduce, and Share Adapted Material.
  70. 2. Exceptions and Limitations. For the avoidance of doubt, where Exceptions
  71. and Limitations apply to Your use, this Public License does not apply,
  72. and you do not need to comply with its terms and conditions.
  73. 3. Term. The term of this Public License is specified in Section 6(a).
  74. 4. Media and formats; technical modifications allowed. The Licensor
  75. authorizes You to exercise the Licensed Rights in all media and formats
  76. whether now known or hereafter created, and to make technical
  77. modifications necessary to do so. The Licensor waives and/or agrees not
  78. to assert any right or authority to forbid You from making technical
  79. modifications necessary to exercise the Licensed Rights, including
  80. technical modifications necessary to circumvent Effective Technological
  81. Measures. For purposes of this Public License, simply making
  82. modifications authorized by this Section 2(a)(4) never produces Adapted
  83. Material.
  84. 5. Downstream recipients.
  85. A. Offer from the Licensor – Licensed Material. Every recipient of the
  86. Licensed Material automatically receives an offer from the Licensor
  87. to exercise the Licensed Rights under the terms and conditions of
  88. this Public License.
  89. B. Additional offer from the Licensor – Adapted Material. Every
  90. recipient of Adapted Material from You automatically receives an
  91. offer from the Licensor to exercise the Licensed Rights in the
  92. Adapted Material under the conditions of the Adapter’s License You
  93. apply.
  94. C. No downstream restrictions. You may not offer or impose any
  95. additional or different terms or conditions on, or apply any
  96. Effective Technological Measures to, the Licensed Material if doing
  97. so restricts exercise of the Licensed Rights by any recipient of
  98. the Licensed Material.
  99. 6. No endorsement. Nothing in this Public License constitutes or may be
  100. construed as permission to assert or imply that You are, or that Your
  101. use of the Licensed Material is, connected with, or sponsored,
  102. endorsed, or granted official status by, the Licensor or others
  103. designated to receive attribution as provided in Section 3(a)(1)(A)(i).
  104. b. Other rights.
  105. 1. Moral rights, such as the right of integrity, are not licensed under
  106. this Public License, nor are publicity, privacy, and/or other similar
  107. personality rights; however, to the extent possible, the Licensor
  108. waives and/or agrees not to assert any such rights held by the Licensor
  109. to the limited extent necessary to allow You to exercise the Licensed
  110. Rights, but not otherwise.
  111. 2. Patent and trademark rights are not licensed under this Public License.
  112. 3. To the extent possible, the Licensor waives any right to collect
  113. royalties from You for the exercise of the Licensed Rights, whether
  114. directly or through a collecting society under any voluntary or
  115. waivable statutory or compulsory licensing scheme. In all other cases
  116. the Licensor expressly reserves any right to collect such royalties.
  117. Section 3 – License Conditions.
  118. Your exercise of the Licensed Rights is expressly made subject to the
  119. following conditions.
  120. a. Attribution.
  121. 1. If You Share the Licensed Material (including in modified form), You
  122. must:
  123. A. retain the following if it is supplied by the Licensor with the
  124. Licensed Material:
  125. i. identification of the creator(s) of the Licensed Material and any
  126. others designated to receive attribution, in any reasonable manner
  127. requested by the Licensor (including by pseudonym if designated);
  128. ii. a copyright notice;
  129. iii. a notice that refers to this Public License;
  130. iv. a notice that refers to the disclaimer of warranties;
  131. v. a URI or hyperlink to the Licensed Material to the extent
  132. reasonably practicable;
  133. B. indicate if You modified the Licensed Material and retain an
  134. indication of any previous modifications; and
  135. C. indicate the Licensed Material is licensed under this Public
  136. License, and include the text of, or the URI or hyperlink to, this
  137. Public License.
  138. 2. You may satisfy the conditions in Section 3(a)(1) in any reasonable
  139. manner based on the medium, means, and context in which You Share the
  140. Licensed Material. For example, it may be reasonable to satisfy the
  141. conditions by providing a URI or hyperlink to a resource that includes
  142. the required information.
  143. 3. If requested by the Licensor, You must remove any of the information
  144. required by Section 3(a)(1)(A) to the extent reasonably practicable.
  145. b. ShareAlike.
  146. In addition to the conditions in Section 3(a), if You Share Adapted
  147. Material You produce, the following conditions also apply.
  148. 1. The Adapter’s License You apply must be a Creative Commons license with
  149. the same License Elements, this version or later, or a BY-SA Compatible
  150. License.
  151. 2. You must include the text of, or the URI or hyperlink to, the Adapter's
  152. License You apply. You may satisfy this condition in any reasonable
  153. manner based on the medium, means, and context in which You Share
  154. Adapted Material.
  155. 3. You may not offer or impose any additional or different terms or
  156. conditions on, or apply any Effective Technological Measures to,
  157. Adapted Material that restrict exercise of the rights granted under the
  158. Adapter's License You apply.
  159. Section 4 – Sui Generis Database Rights.
  160. Where the Licensed Rights include Sui Generis Database Rights that apply to
  161. Your use of the Licensed Material:
  162. a. for the avoidance of doubt, Section 2(a)(1) grants You the right to
  163. extract, reuse, reproduce, and Share all or a substantial portion of the
  164. contents of the database;
  165. b. if You include all or a substantial portion of the database contents in a
  166. database in which You have Sui Generis Database Rights, then the database
  167. in which You have Sui Generis Database Rights (but not its individual
  168. contents) is Adapted Material, including for purposes of Section 3(b); and
  169. c. You must comply with the conditions in Section 3(a) if You Share all or a
  170. substantial portion of the contents of the database.
  171. For the avoidance of doubt, this Section 4 supplements and does not replace
  172. Your obligations under this Public License where the Licensed Rights include
  173. other Copyright and Similar Rights.
  174. Section 5 – Disclaimer of Warranties and Limitation of Liability.
  175. a. Unless otherwise separately undertaken by the Licensor, to the extent
  176. possible, the Licensor offers the Licensed Material as-is and as-available,
  177. and makes no representations or warranties of any kind concerning the
  178. Licensed Material, whether express, implied, statutory, or other. This
  179. includes, without limitation, warranties of title, merchantability, fitness
  180. for a particular purpose, non-infringement, absence of latent or other
  181. defects, accuracy, or the presence or absence of errors, whether or not
  182. known or discoverable. Where disclaimers of warranties are not allowed in
  183. full or in part, this disclaimer may not apply to You.
  184. b. To the extent possible, in no event will the Licensor be liable to You on
  185. any legal theory (including, without limitation, negligence) or otherwise
  186. for any direct, special, indirect, incidental, consequential, punitive,
  187. exemplary, or other losses, costs, expenses, or damages arising out of
  188. this Public License or use of the Licensed Material, even if the Licensor
  189. has been advised of the possibility of such losses, costs, expenses, or
  190. damages. Where a limitation of liability is not allowed in full or in
  191. part, this limitation may not apply to You.
  192. c. The disclaimer of warranties and limitation of liability provided above
  193. shall be interpreted in a manner that, to the extent possible, most
  194. closely approximates an absolute disclaimer and waiver of all liability.
  195. Section 6 – Term and Termination.
  196. a. This Public License applies for the term of the Copyright and Similar
  197. Rights licensed here. However, if You fail to comply with this Public
  198. License, then Your rights under this Public License terminate
  199. automatically.
  200. b. Where Your right to use the Licensed Material has terminated under
  201. Section 6(a), it reinstates:
  202. 1. automatically as of the date the violation is cured, provided it is
  203. cured within 30 days of Your discovery of the violation; or
  204. 2. upon express reinstatement by the Licensor.
  205. For the avoidance of doubt, this Section 6(b) does not affect any right
  206. the Licensor may have to seek remedies for Your violations of this Public
  207. License.
  208. c. For the avoidance of doubt, the Licensor may also offer the Licensed
  209. Material under separate terms or conditions or stop distributing the
  210. Licensed Material at any time; however, doing so will not terminate this
  211. Public License.
  212. d. Sections 1, 5, 6, 7, and 8 survive termination of this Public License.
  213. Section 7 – Other Terms and Conditions.
  214. a. The Licensor shall not be bound by any additional or different terms or
  215. conditions communicated by You unless expressly agreed.
  216. b. Any arrangements, understandings, or agreements regarding the Licensed
  217. Material not stated herein are separate from and independent of the terms
  218. and conditions of this Public License.
  219. Section 8 – Interpretation.
  220. a. For the avoidance of doubt, this Public License does not, and shall not
  221. be interpreted to, reduce, limit, restrict, or impose conditions on any use
  222. of the Licensed Material that could lawfully be made without permission
  223. under this Public License.
  224. b. To the extent possible, if any provision of this Public License is deemed
  225. unenforceable, it shall be automatically reformed to the minimum extent
  226. necessary to make it enforceable. If the provision cannot be reformed, it
  227. shall be severed from this Public License without affecting the
  228. enforceability of the remaining terms and conditions.
  229. c. No term or condition of this Public License will be waived and no failure
  230. to comply consented to unless expressly agreed to by the Licensor.
  231. d. Nothing in this Public License constitutes or may be interpreted as a
  232. limitation upon, or waiver of, any privileges and immunities that apply to
  233. the Licensor or You, including from the legal processes of any jurisdiction
  234. or authority.
